(Washington, DC)  —  A federal appeals court has upheld a ban on using chalk to write messages on the sidewalk outside of the White House.  On Tuesday, the U.S. Court of Appeals ruled that the District’s defacement statute banning the defacing or defiling of public or private property is constitutional.  The law was challenged by the Reverend Patrick Mahoney after he was told to stop scribbling with sidewalk chalk during a protest of President Obama’s views on abortion and to mark the anniversary of the Roe v. Wade Supreme Court decision.
