Judge Rejects Fairfax Co. Schools’ Objection To Pronoun Policy Lawsuit

A Fairfax County Circuit Court judge rejected Fairfax County Public Schools’ (FCPS) latest attempt to dismiss a lawsuit challenging its gender pronoun policy. Filed by students, the lawsuit claims the policy violates free speech and religious rights by compelling students to use classmates’ preferred pronouns and names under threat of discipline for “misgendering” or “deadnaming.”

The plaintiffs also argue that FCPS’ bathroom policy, which allows transgender students to use facilities matching their gender identity, discriminates against other students by relegating them to private restrooms if uncomfortable.

America First Legal Senior Advisor Ian Prior, representing the students, called the decision a victory for free speech and religious freedom, while FCPS Superintendent Michelle Reid reaffirmed the district’s commitment to inclusivity and support for all students. The lawsuit will proceed.
